A. ACCEPTANCE OF TERMS

KTPSDATA provides a wide range of online products and services, including but not limited to data bundle airtime recharge/Virtual Top Up, bills payment, airtime to cash converter.

By using the service in any way, you agree to comply with the TOU and any applicable posted rules and regulations for all services, which may change as time evolved. Should you object to any term or condition of the TOU, any rule, or any subsequent modifications thereof or become disagree with KTPSDATA in any way, your only recourse is to immediately discontinue use of your KTPSDATA account.

Should any infraction arise, KTPSDATA has the right but is not obligated to strictly enforce the TOU through self-help, active investigation, litigation and prosecution.

B. THE CONDITIONS TO USE OUR SERVICES

In order to access and use our Services, you must:

1. Be at least 16 years of age to be able to access or use the Services or create a KTPSDATA Account ("User Account", "Account" "Wallet"), as the Services are not intended for under 16. The Services are not available to any User previously removed from the Services (or whose User Account have been terminated) by KTPSDATA. You represent and warrant that you possess the legal right and ability to enter into these Terms and to use the Services in accordance with these Terms.
2. Be registered with us on our App or website.
3. Provide all information necessary by us, such as your name, gender, date of birth, email address, phone number, nims, Bank Verification Number (Where applicable), online credentials for registering with KTPSDATA hence other information as we request from time to time (collectively, "User Information").

By giving KTPSDATA your BVN, you authorize KTPSDATA to collect and save your information from the BVN database as part of our Know Your Customer ("KYC") information to fulfil regulatory requirements. All KYC data collected will be treated as confidential. You also permit us to use your BVN to monitor, prevent and detect fraudulent activities and share the same with CBN authorised stakeholders, for the purpose of deterring financial and airtime sales fraud.

4. Ensure that all User Information you provide to us from time to time is genuine, accurate, current and complete, and you agree not to misrepresent your identity or your User Information. You agree to promptly notify us of changes to your User information by updating your User account on the App. If we approve of your registration, you will be authorized to use the Services, subject to these Terms and provided that the Services will not be used for fraud and share with third party.

C. SIGN UP

1. You must have thoroughly read and understood our terms and conditions, privacy policy and disclaimer before sign up.
2. You are task to sign up with your real phone number, email and names which must tally with your bank account name.

D. TRANSACTING

Your KTPSDATA wallet can be funded via transfer, mobile bank transfer/USSD code transfer, bank deposit or Paystack(ATM card funding). You are therefore to login to our platform, and select your preferred method of funding.

E. RULES THAT APPLY TO MERCHANT TRANSACTIONS AND THIRD PARTY WEBSITES

1. When making a payment in exchange for services like data, airtime recharge top-up and bills payment on KTPSDATA, you will be tasks to confirm the transaction. At this time, you will also be requested to enter your secret pin to authorize the transaction. By entering your pin to confirm the transaction you agree and confirm that you have authorized the transaction. You cannot directly reverse or cancel any payment once it has been approved by you.

F. HOW WE TREAT YOUR PERSONAL INFORMATION?

1. KTPSDATA honor and cherish you and is committed to protecting your privacy. You understand that by accessing or using the Services and/or submitting your User Information through the Services, you consent to the collection, use, storage and disclosure of your user information as set out in our privacy policy.

G. THE SECURITY MEASURES WE PUT IN PLACE FOR YOUR KTPSDATA ACCOUNT/ WALLET

1. When signing up for an Account, you are mandatory to confirm your phone number, pin, and will be prompted to create a password or TouchID for applicable channels.
2. You are solmely responsible for protecting your password and pin. In view of this, you are responsible for all transactions that occur on your Account as well as applicable channels and you undertake to notify us against any claims made in respect of transactions made on your Account. For fingerprint access, you are responsible for ensuring that the fingerprints stored on your smartphone are yours alone and notify us against any claims made in respect of transactions made on your Account using fingerprint access.

H. FEES AND CHARGES

1. Using our airtime to cash converter, KTPSDATA accepts airtime of all networks. The convenience fee for MTN is 21%, Airtel and 9Mobile is 30%, and Glo at 25%.
2. These rates are not fixed. It changes according to the market dynamics(Laws of demand and supply). KTPSDATA reserves the right to alter the rates at any given point in time to reflect the current market trend without a prior notice to customers.

I. PROCEDURES FOR THE SUSPENSION/TERMINATION OF ACCOUNTS

1. You agree that to the extent permitted by applicable law, we may, in our sole discretion and without liability to you, terminate or suspend access to your use of the Services, Content, or your Account for any reason, including, but not limited to, your breach of these Terms.
2. We will not be responsible to you for any careless indulgence, errors, direct, indirect, consequential or special damages arising from any act or omission by us or any third party for whom we are responsible; whether arising in contract or statute, or if we terminate or suspend your Account in accordance with these Terms.
3. In any case where your KTPSDATA Account is termited for any reason and has a balance of funds, you may make a request to our customer service for your balance, and this will be made available to you for withdrawal barring any legal or regulatory provisions preventing such a withdrawal.
